GEDClean32 Software License

Below is the text of the software license governing the use of GEDClean32. This license will be included with each purchased copy of GEDClean32, and is available from the "Help" menu of the program. Please review this license carefully before purchasing GEDClean32.

This Agreement sets forth the license terms and conditions for using GEDClean32 ("Software").

This License is effective until terminated. You may terminate it at any time by destroying the Software together with any copies currently in your possession. The License also terminates if you fail to comply with the terms and conditions of this agreement, and additionally you need to destroy any copies or variations of the software.

1. GRANT OF LICENSE. RaynOrShyn Enterprises ("RaynOrShyn"), grants to each registered purchaser the right to use all or a portion of this Software provided that (i) the Software is not distributed for profit; (ii) the Software may NOT be modified; (iii) all copyright notices are maintained on the Software; and (iv) the licensee/end user agrees to be bound by the terms of this Agreement.

One registered copy of GEDClean32 may either be used by a single person who uses the software personally on one or more computers, or installed on a single workstation used non-simultaneously by multiple people, but not both.

You may access the registered version of GEDClean32 through a network, provided that you have obtained individual licenses for the software covering all workstations that will access the software through the network.

2. COPYRIGHT. The Software is owned by RaynOrShyn and is protected by United States copyright laws and international treaty provisions. You may not remove the copyright notice from any copy of the Software or any copy of the written materials, if any, accompanying the Software.

3. OTHER RESTRICTIONS. This License Agreement is your proof of license to exercise the rights granted herein and must be retained by you. You may not rent or lease the Software. You may not reverse engineer, decompile or disassemble the Software.

NO WARRANTY. ANY USE BY YOU OF THE SOFTWARE IS AT YOUR OWN RISK. THE SOFTWARE IS PROVIDED FOR USE "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAYNORSHYN DISCLAIMS ALL WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. RAYNORSHYN IS NOT OBLIGATED TO PROVIDE ANY UPDATES TO THE SOFTWARE.

NO LIABILITY FOR CONSEQUENTIAL DAMAGES. In no event shall RaynOrShyn be liable for any damages whatsoever (including, without limitation, incidental, direct, indirect special and consequential damages, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of the use or inability to use this Software, even if RaynOrShyn has been advised of the possibility of such damages. Because some states/countries do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.

INDEMNIFICATION BY YOU. If you distribute the Software in violation of this Agreement, you agree to indemnify, hold harmless and defend RaynOrShyn from and against any claims or lawsuits, including attorney's fees that arise or result from the use or distribution of the Software in violation of this Agreement.

This Agreement shall be construed, interpreted and governed by the laws of the State of Maine, except the federal laws which govern the copyrights and registered trademarks. You agree that this is the complete and exclusive statement of the Agreement between you and RaynOrShyn which supersedes any proposal or prior agreement, oral or written, and any other communications between us regarding the subject of this Agreement. If any provision of this Agreement is found unenforceable, it will not affect the validity of this Agreement, which shall remain valid and enforceable according to its terms.
